Poison in legal battle with Kid Rocker over “alleged claims of Copyright Infringement” of 4 different Poison songs including their hit “Talk Dirty To Me”

To all our new friends and fans. You guys rock. We truly love you all. Thanks so much for your support! Nov 5 Poison and Kid Rocker will begin discovery over the alleged claims of Copyright Infringement for I wont forget you babe, Ride the wind, Fallen Angel, and writing credits for Talk dirty to me. We have received many E-Mails regarding copyrights. Jimmy Vayne (AKA Stonich hold copyrights (filed 1981) for songs infringed “Ride the Wind” and “Fallen Angel” Billy McCarthy for “I wont forget you babe” and contract for 50% of writing talk dirty to me. This case began in October 2011 when I FIRST LEARNED of the infringements. WE DID NOT WAIT. I simply don’t listen to Poison even though C.C. Deville was our lead guitarist and learned all the songs infringed upon and kept Kid Rocker tapes containing 10-14 Kid Rocker Original songs. So keep the support coming. Kid Rocker will NOT let Poison get away with this!

Thanx again we love you all. Jimmy Vayne Billy McCarthy KID ROCKER

The statement above is from the official Kid Rocker page on their Facebook.

Check out “Talk Dirty To Me” on YouTube by the Screemin’ Mimi’s featuring CC DeVille on guitar. Watch from the .40 second mark and you will hear “Talk Dirty To Me”. The guitar, vocals, lyric, melody and stops are nearly identical to Poison’s version.

Metal Sludge asked about this in our 20 Questions with Billy McCarthy (pka Billy Dior from D’Molls) in August 2004.

Also here is an article on Yahoo news groups that quotes a radio interview with CC DeVille where he admits the song “Talk Dirty To Me” was a song from the Screemin’ Mimi’s. A band in which DeVille and plaintiff (Billy McCarthy) played in together before DeVille joined Poison.

The following exchange with the two is detailed below.

McCarthy: “How many albums has Poison sold in their career?”

DeVille: “20 million records.”

McCarthy: “I haven’t made 20 thousand dollars in my career yet.”

DeVille: “Let me tell you something, Billy. For that first album, you should have made some money… Billy and I used to play in the same band.”

McCarthy: “Yes we did, we played in Screamin’ Mimi’s.”

DeVille: “And it was an excellent band. In fact, we have video tapes of us doing ‘Talk Dirty To Me’.”
